This Privacy Policy is provided to outline the privacy practices associated solely with TrackOFF.com, a website maintained by TrackOFF, LLC (“TrackOFF,” the “Company,” or “us”). The Privacy Policy does not apply to the use of the TrackOFF privacy software. Please review the TrackOFF End User License Agreement (“EULA”) for the terms that govern the use of the software.

CHANGES TO THE PRIVACY POLICY

We reserve the right to change this Privacy Policy at any time without prior notice and will notify you of material changes by posting the revised Privacy Policy on the TrackOFF website. We may also provide notice to you in other ways in our discretion, such as through contact information you have provided. Any changes will be effective immediately upon the posting of the revised Privacy Policy unless otherwise specified and your continued use of the TrackOFF website after the effective date of the revised Privacy Policy will constitute your consent to those changes. However, We will not make material changes to how We treat previously collected Personal Information about you without providing notice and giving you the chance to consent (opt-in or opt-out). Note, however, that you may need to consent to our new policies in order to continue to use the TrackOFF website.

INFORMATION WE COLLECT AND HOW WE USE IT

Information You Provide Us

We may ask you to provide personally identifiable information (“PII”), such as your name, telephone number, email address, or payment and billing information in order to facilitate your transactions with us.

Information Received by Our Web Servers

Under normal circumstances, every time you visit a website your web browser silently broadcasts data to the web servers hosting the website, including your computer’s IP address and information about your computer’s hardware and software. Many companies claim that this data isn’t PII but we disagree (and that’s one reason we recommend that you use TrackOFF). As is the case with most standardly configured web servers, ours automatically receive and log your PII. For information about the information collected by the TrackOFF Software, please see the End User License Agreement for the TrackOFF Software (available at https://www.trackoff.com/en/eula).

Information Collected through Third-Party Services Operating on TrackOFF.com

We use third party services to analyze web traffic on and to TrackOFF.com. These services are described in more detail below.

We use Google analytics to help optimize traffic to and on TrackOFF.com. For instance, Google analytics provides information about the search terms used by consumers to reach TrackOFF.com. Under this example, if we notice that a statistically significant number of visitors visit TrackOFF.com after searching for “privacy software,” then we may enhance our marketing strategy to reach such individuals.

If you would like to opt-out of Google’s Analytics program, or read more about Google’s privacy policies, we have provided links below.

OUR USE OF INFORMATION

We may use information collected about You, including PII, to (1) allow you to utilize the TrackOFF Software; (2) provide customer service; (3) process a transaction; (4) investigate and prevent fraudulent transactions; (5) process your registration, including verifying your information is active and valid; (6) improve Our products and services; (7) contact you with regard to your use of the TrackOFF software and, in our discretion, changes to this Privacy Policy, the TrackOFF End User License Agreement, or any other agreement between You and Us; and (8) for purposes disclosed at the time you provide your PII or otherwise with your consent.

CHILDREN

The TrackOFF website is not intended for use by anyone younger than the age of 18 and we do not knowingly collect PII from children younger than age 13. If we learn that we have inadvertently collected PII from a user who is younger than age 13, we will delete the information from our active databases.

DISCLOSURE OF INFORMATION TO THIRD PARTIES

We may share the information we have collected about you, including PII, as disclosed at the time you provide your information, as described in this Privacy Policy, with your consent, and in the following circumstances.

California residents, please see below for additional information on “Your California Privacy Rights.”

Third Parties Providing Services on Our Behalf

We may share information about you, including PII, with third-party vendors including our payment-processing vendor in order to process payments and prevent fraudulent transactions.

We may share non-personally identifying information with third parties to help optimize web traffic, conversions, or for usage record keeping.

Administrative and Legal Reasons

We may also transfer and disclose user information, including PII, to third parties (i) in the event we are required to respond to subpoenas or other legal process or if in our opinion such disclosure is required by law; or (ii) to protect and/or defend the personal safety, rights, property, or security of Company, our customers, or a third party.

Business Transfers

We reserve the right to disclose and transfer all information related to our services, including PII: (i) to a subsequent owner, co-owner or operator of Company; or (ii) in connection with a corporate merger, consolidation, restructuring, bankruptcy, the sale of certain of Our ownership interests, assets, or both, or other company change, including, without limitation, during the course of any due diligence process.

YOUR PRIVACY CHOICES AND CHANGING YOUR INFORMATION

We do not use your PII to send you marketing emails or mobile messages. Please note, however, that we reserve the right to send you certain communications relating to your account or use of Our software, such as administrative and services announcements, or announcements relating to your subscription.

You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information provided at time of your purchase. To view the PII we possess about you, or to request changes to it, please email [email protected] with your request.

YOUR CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798.83 permits California residents to request certain details about whether, how, and to whom their personal information was disclosed to third parties for direct marketing purposes within the last calendar year, unless the business adopts a policy of not disclosing such information without the customer’s prior consent.

As stated above, TrackOFF does not disclose customers’ personal information to third parties for direct marketing purposes.

THIRD PARTY CONTENT, SITES & DEVICES

The TrackOFF website may contain content or features provided by third parties (including the private search function), or links to third-party content or websites that Company does not control. Those third parties may or may not have their own published privacy policies, and We are not responsible for the privacy practices employed by any third party.

We do not ensure or warrant the security of any information we collect, and your use of our services and provision of information to us is at your own risk.

By accessing or using our services, or by providing us with any information, you consent to the transfer, processing, and storage of your information in and to the Untied States, even if the privacy laws of the United States are not as comprehensive as those in the country where you reside or are a citizen.
